Key changes to the CLP regulation and Poison Centre rules for distributors
Application from 2027
From 1 January 2027, distributors of chemical mixtures will face explicit obligations under Article 45 of the CLP Regulation. This measure aims to tackle the lack of medical information across the supply chain. This crucial data is sent to the ECHA Poison Centre and shared with designated poison centres in each member state where a hazardous chemical is sold. The new rules will clarify the exact role these businesses must play to guarantee safety.
Why? Due to flaws detected in the market
A pilot project by the ECHA enforcement forum has revealed some alarming figures. 19% of the products analysed completely lacked a valid notification. Furthermore, 15% of the items failed to include the mandatory UFI code on their label. In over a third of these cases, distributors were directly responsible for the gap.
When must businesses take action?
Distributors will have to take responsibility in two clear scenarios. Firstly, if they place a mixture on the market in a European country without a prior notification. Secondly, if they rebrand the product or use their own label.
To comply with the law, they can ask their suppliers to extend the existing notification. The other option available will be to submit a completely new registration on their own.
Control tools and technical support
Companies are advised to check that the UFI identifier is clearly visible on the packaging. Suppliers can provide copies of the submission report alongside the Safety Data Sheet (SDS). This document outlines the specific market areas covered and the assigned code.
To help resolve any doubts, the official ECHA guides have already been fully updated.
