New ECHA SME rules from 5 February 2027
Chemical firms must pre-verify their business size two months before registration to secure REACH and CLP fee discounts.
Small and medium-sized enterprises (SMEs) operating within the European chemical sector face a major regulatory shift. From 5 February 2027, the European Chemicals Agency (ECHA) will introduce a strict prior (ex-ante) verification model to confirm a company’s business size. This assessment will become a mandatory prerequisite for any firm wishing to claim the reduced registration fees available under the REACH and CLP frameworks.
Shift to upfront verification
Up until now, businesses could claim these fee reductions upfront, with ECHA auditing their financial status at a later date. This retrospective approach is being replaced by a more rigid system designed by the European Commission. The most critical change for businesses is the compulsory notice period: firms must now submit their size validation requests at least two months before lodging any actual registration dossier or official application.
To secure this approval, businesses will need to provide robust documentary evidence. This includes detailed records of employee headcounts, annual turnover figures, and balance sheets. Crucially, the disclosure must also encompass data from any partner or linked enterprises, preventing larger corporate structures from wrongly claiming small-business status.
On a brighter note, once ECHA grants the SME status, the decision will remain valid for three years. During this timeframe, businesses can complete multiple submissions without needing to resubmit their corporate credentials each time.
However, ECHA has issued a stark warning against non-compliance. Attempting to submit a dossier with an unauthorised discount, or misrepresenting financial figures, will lead to severe financial penalties. Defaulters will be forced to pay the full standard fee immediately, alongside hefty administrative charges, meaning meticulous forward planning is now vital.
