What are the different REACH roles for the companies?
The REACH Regulation (Registration, Evaluation, Authorisation and Restriction of Chemicals) has transformed the way companies manage chemicals in the European Union. This regulatory framework, in force since 2007, aims to protect human health and the environment while promoting competitiveness and innovation in the industry. In this context, companies assume crucial REACH roles based on their specific business activities.
1. Manufacturers
Manufacturing companies are those that produce substances within the EU or the EEA, either for their own use or for marketing. Under certain conditions, manufacturers must register substances with the European Chemicals Agency (ECHA), providing data on their properties and risks.
2. Importers
Those who import substances from outside the European Union or the EEA must ensure that they comply with REACH standards. This involves active communication with suppliers and the submission of a REACH registration dossier for the substance when certain conditions are met.
Manufacturers and importers of substances may have REACH registration obligations arising from their business activities.
3. Downstream Users
Companies that use chemicals in their production processes and must ensure their safe use. They may have specific communication obligations within the supply chain.
4. Distributors
Distributors market chemicals but do not handle them or add chemicals to their final products. These companies must follow safety instructions and communicate relevant information to their customers and, when necessary, to ECHA.
5. Article Producers
Companies that manufacture products where the shape and function take precedence over the chemical composition are considered article producers under REACH. They must notify ECHA of the presence of substances of very high concern (SVHCs) in their products if they exceed certain thresholds.
6. Importers of Articles
When articles are imported into the European Union and contain substances subject to authorisation, importers also have obligations under REACH. They must notify ECHA if SVHCs in articles exceed certain thresholds.
7. Only Representatives
This role is essential for non-European companies that want to access the European Union market without having a physical presence in the region. Only Representatives can register chemicals and offer services to ensure that all REACH obligations are effectively met.
