Important Update: EU Updates Table of Harmonized Entries in Annex VI to CLP
Update on Annex VI to CLP: This may affect manufacturers, importers, and downstream users of chemicals
There’s a new update you need to be aware of regarding the Annex VI to CLP. This may affect classification and labeling of chemicals under the CLP Regulation (Regulation (EC) No 1272/2008). This regulation plays a vital role in ensuring the safe handling and use of chemicals across the European Union.
What’s New?
Two new Delegated Regulations have been published, revising and incorporating new entries into the CLP classification and labeling list:
- Delegated Regulation (EU) 2023/1435: This regulation revises the classification of five existing entries in the CLP list: CELEX_32023R1435_EN_TXT
- Delegated Regulation (EU) 2024/197: This regulation incorporates a significant number of changes, introducing 28 entirely new entries and revising the classification of another 24 existing entries: OJ_L_202400197_EN_TXT
These updates reflect the latest scientific knowledge and risk assessments for various chemicals.
Why it Matters
Non-compliance with the CLP Regulation can have serious legal consequences for your business. Improper classification and labeling of chemicals can lead to:
- Fines: Regulatory authorities can impose significant fines for non-compliance.
- Product recalls: Products with inaccurate labeling may need to be recalled from the market, causing reputational damage and financial losses.
- Supply chain disruptions: Non-compliant products may be blocked from import or sale, hindering your ability to meet customer needs.
What You Need to Do
To ensure your business remains compliant with the updated CLP Regulation, here are some essential steps you should take:
- Review the Updated List: Familiarize yourself with the changes introduced by Delegated Regulations (EU) 2023/1435 and (EU) 2024/197. You can access these regulations and the updated CLP list on the European Commission website.
- Assess Your Formulations: Identify all the substances present in your formulations and compare them against the updated CLP list. Determine if the classification or labeling requirements for any of these substances have changed.
- Update Safety Data Sheets (SDSs): If the classification of any substance in your formulations has changed, you must update the corresponding Safety Data Sheets (SDSs) to reflect the new classifications and labeling requirements.
- Update Your Labels: Ensure the labels on your products accurately reflect the updated classifications and labeling requirements. This includes hazard pictograms, signal words, and hazard statements.
- Train Your Employees: Educate your employees about the updated CLP requirements and their responsibilities for handling and using chemicals safely.
- Improve Traceability: Strengthen your communication and documentation system with your suppliers. This will ensure you receive timely notifications about any changes in the classification of substances they supply, allowing you to react quickly and maintain compliance.
Application Deadlines
It’s crucial to note that the updated classifications and labeling requirements come into effect at different times:
- Delegated Regulation (EU) 2023/1435: The changes in this regulation apply from February 1, 2025.
- Delegated Regulation (EU) 2024/197: The changes in this regulation apply from September 1, 2025.
