In the European Union, producers, importers and downstream users of chemical products (individual or combined substances) must comply with Regulation (EC) nº 1907/2006, commonly known as the REACH Regulation.
This legislation has been applicable in the EU since June 1, 2007. It includes a range of requirements for chemical companies and those handling chemical products, such as registration, authorisation, evaluation and restriction.
The text of the REACH Regulation is subject to regular revision, and additional requirements can be imposed on the industry.
Principal requirements of the REACH Regulation
One of the most notable requirements of this regulation is REACH registration.
Any companies in the European Union that produce or import substances in quantities of 1 tonne or more annually must register with the European Chemicals Agency (ECHA). The production of any non-registered substances is prohibited.
REACH registration is only available to companies based in the EU, and companies abroad cannot register the substances they export to Europe. However, they can designate a European company as their only representative and have them complete REACH registration in their name.
This is an increasingly common practice, as it gives suppliers based outside the EU a commercial advantage by freeing their European customers from the need to register. No longer considered importers, these customers simply become downstream users and can continue to purchase from their supplier without any additional concerns.
It is important to understand that after REACH registration, additional obligations to update or improve this registration may exist. REACH dossiers are living documents that may need to be reviewed for companies to legally remain in the market.
Safety data sheets
Another notable requirement is the preparation and distribution of safety data sheets.
These essential documents inform of the risks of hazardous substances and mixtures throughout the industry’s supply chain. The REACH Regulation defines the necessary contents and form of these documents in annexe II (currently modified by Regulation 2015/830).
