In the European Union, manufacturers, importers and downstream users of chemical products must comply with Regulation (EC) nº 1272/2008 on classification, labelling and packaging of substances and mixtures. This regulation was published on December 31, 2008, after the criteria for classification proposed by the United Nations’ Globally Harmonized System (GHS) was adopted.
The CLP Regulation repealed Directives 67/548/EEC and 1999/45/EC and forced all chemical industries to adapt to new criteria for classification.
Regulation (EC) nº 1272/2008 (CLP) is one of the most influential EU regulations. Its pictograms are widely recognized—even by the general public.
Although it is widely known and mandates that information on chemical products be provided for the general public, not all companies comply with this regulation. If you have any compliance issues, we have a range of solutions.
Primary obligations of the CLP Regulation:
Companies must provide safety data sheets and labels for their products that meet with its criteria for classification.
According to article 45 of the CLP Regulation, all companies that sell mixtures classified as hazardous on the basis of their health or physical effects must notify the Poison Centres in each of the member states (INTYFC, INRS, BFR, etc.). This notification must be completed before the substance is sold. It must also be updated if any changes are made to the substance’s composition, or if it ceases to be available.
Also, companies that produce or import substances that are subject to the REACH Registry and/or are classified as dangerous have one month from the date of sale to inform the Classification and Labelling Inventory of the European Chemicals Agency (ECHA).

BASIC CONCEPTS
Where?
You must submit all the necessary information on the dangers of the mixture, its composition and the company responsible for its sale to the Poison Centres.
Why?
To inform others of the dangers of products sold in the European Union, so that the necessary precautionary measures and cures can be applied in case of an emergency.

According to whom?
In keeping with article 45 of the CLP Regulation, all mixtures classified as hazardous on the basis of their health or physical effects must be reported to the European Poison Centres in each of the states where they are sold.
What?
All information on the product must be included in a IUCLID file and submitted to the designated entities using the ECHA Submission Portal so they can validate the notification.
How?
