- Wood Preservatives: Chemicals applied to wood to protect it from decay, fungus, and insect damage.
- Antifouling Products: Paints or coatings applied to ships, boats, and other marine structures to prevent the growth of marine organisms like barnacles and algae.
- Construction Material Preservatives: Chemicals added to construction materials like concrete and timber to protect them from decay, fungus, and insect damage.
Aligning with European Standards
On May 12, 2021, the German government enacted an ordinance amending existing national biocidal laws. This revision aligns Germany’s regulations with the European Union Biocidal Products Regulation (BPR). The BPR establishes a harmonized framework for the authorization, marketing, and use of biocidal products across the European Union.
Beyond Bricks and Mortar: Online Sales Affected Too
The new regulations don’t just apply to physical stores. Online and mail-order retailers will also be subject to these restrictions. Before shipping biocides classified under the restricted categories, online retailers must conduct a mandatory consultation with the buyer. This consultation can be executed via phone or video call, ensuring that the customer receives proper education on the potential risks associated with using these products.
Exemptions: Not All Biocides are created equal
The new regulation acknowledges the varying levels of risk associated with different biocidal products. Biocides eligible for the simplified authorization procedure under the BPR, typically containing less concerning substances, are exempt from the self-service ban. These products are deemed less risky and may continue to be sold through self-service channels.
